Commitment to Intellectual Property Protection
  • XCITY (hereinafter referred to as “this site”) is committed to respecting and protecting the intellectual property rights of all individuals and organizations. The unauthorized use, reproduction, distribution, or display of copyrighted works, trademarks, or other intellectual property on this site’s platform is strictly prohibited. This includes, but is not limited to, videos, images, audio, text, and other content uploaded or shared by users.
Compliance with Applicable Laws (DMCA)
  • This site complies with all applicable intellectual property laws, including the United States Digital Millennium Copyright Act (DMCA) and equivalent international regulations. When intellectual property infringement is reported or detected, this site will take prompt responsive action.
Procedure for Reporting Infringement

  4. 4Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material at issue is not authorized by the intellectual property owner, its agent, or the law.
  5. 5.Statement of Accuracy: A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the intellectual property owner or are authorized to act on behalf of the owner.
  6. 6.Signature: A handwritten or electronic signature of the person authorized to act on behalf of the intellectual property owner.

Response to Infringement Notices
Upon receipt of a valid infringement notice, this site will take the following actions:
  • Removal or Disabling of Access: The allegedly infringing content will be promptly removed or access to such content will be disabled.
  • Notification to the User: The user who uploaded the content will be notified of the removal and the reasons therefor.
  • Counter-Notification Process: If a user believes that the content was removed in error, the user may submit a counter-notification. A valid counter-notification must include the following:
    1. Identification of the removed content and identification of where it appeared on the platform prior to removal.
    2. A statement, made under penalty of perjury, that the user has a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
    3. The user’s name, address, telephone number, and a statement consenting to the exclusive jurisdiction of the Tokyo District Court.
    4. A handwritten or electronic signature.
  • Restoration of Content: Upon receipt of a valid counter-notification, and if no further legal action is taken by the claimant (rights holder) within ten (10) to fourteen (14) business days, this site may, at its sole discretion, restore the content.
Repeat Infringer Policy
This site maintains a policy regarding repeat infringers in accordance with the DMCA and other applicable laws. Users who repeatedly infringe intellectual property rights may be subject to account suspension or termination at the sole discretion of this site.
Consequences of False Claims
Filing a false or misleading infringement notice or counter-notification may result in legal liability. This site reserves the right to take appropriate action against users who knowingly submit false claims, including account suspension or termination.
Monitoring and Enforcement
This site employs manual processes to detect and address potential intellectual property infringement. However, as it is not possible to actively monitor all content uploaded to the platform, this site relies on notices from rights holders with respect to specific instances of infringement.
